A great article that lays out some of the legal precedence of failing to comply with cybersecurity and the implications for boards that fail to address cybersecurity going forward. Remembering that we are at the start of the journey, not the end and cyber regulation is only just starting to make its way onto statute.
Regulations like the EU NIS 2.0 Directive that lays out obligations for EU Member states to write into law requirements to oversight and assure CNI providers compliance of cyber risk management, temporarily remove members of the management board for failing to comply with the Directive and in the most extreme cases remove licenses to trade and hold accountable board members for breach of their duties to ensure compliance with the Directive.
