A great read about the changing cyber compliance landscape and its potential impact on boards outside the U.S. With the recent Uber case and criminal prosecution of the ex-CSO, and the announcement last week by the FTC to take action against the CEO of Drizly. In both cases cyber attacks resulted in data breaches and the CISO (Uber) and CEO (Drizly) were found not to have met their corporate and legal obligations and held personally liable.
Cyber regulation is moving quickly and finding precedent in the board room, with both civil and criminal prosecutions. The regulatory travel does not appear to be slowing down and while there is little precedence outside the U.S to hold boards accountable, organisation that require access to U.S capital markets; sell digital products and services to the U.S or EU; or deliver CNI. May find themselves accountable for cyber compliance and in the event of an attack.
The warning signs are there and when one sees the road ahead and the opportunities for regulatory compliance and enforcement, the FUD debate is mute.
