An important read for those following US cybersecurity risk management and regulatory enforcement. The US Department Of Justice (DoJ) announced the first resolution under its Civil Cyber-Fraud initiative using the False Claims Act (FCA). Investigated by State Department OIG and US Air Force with civil settlement resolution under Whistle-blower provisions under the FCA. Resulting in a settlement of $930,000 between the DoJ and Comprehensive Health Services (CHS).

The settlement provides an interesting case in terms of the target company, the infringement dates and governing contract clauses. Denoting the breadth of infringement the DoJ is willing to investigate and the effort the DoJ is willing to put into enforcing cyber-related contract violations. The DoJ civil fraud initiative made clear the intention to identify cyber related contractual infringements and use a whistle-blower program.

The Department of the Air Force Office of Special Investigations (OSI) is undeterred in its approach to hunting down fraud within our Foreign Military Sales programs and ensuring the offenders are held accountable,” said Special Agent in Charge Nicholas J. Groesbeck of OSI Procurement Fraud Detachment 4, Wright-Patterson AFB, OH. We applaud the complainant for coming forward, which allowed our joint partners to protect the governments procurement process and carry out the warfighting mission.”

One suspects we will see plenty more.
