Brian Levine thank you for posting this. It is a really important post and any security professional should read this with great care and attention. As cyber regulation develops, cyber attacks increase in frequency, severity and complexity the decisions that you make every minute of every day, could be called back at a later date to be held as fact.
The Uber CSO made one comment that stuck, when asked what he would have done differently – ‘I would have sort advice from external counsel.’
Many professions hold themselves to professional standards through professional bodies, including lawyers, accountants, engineers and doctors. They do this for many good reasons as membership of professional bodies is often used as a bar by which professionals are judged. Cyber is now a profession that is being held to the professional standards bar and if one is considered the cyber expert on to the board then one must ensure that one works to the highest professional standards. As it maybe called into question by a regulator or court. From personal experience there are many barristers that one would not want to site in front of, in the event of a cyber event. They get paid to plead their clients case, not yours.
Beware of what you wish for, getting a seat at the board table comes with so many challenges.
