Continuing questions following the outcome of the recent settlement between Zurich and Mondelez case, raising more questions for insurance policies and war exclusions? Agreeing role of nation states, their proxy’s and criminals in cyber attacks, and what is and what is not an act of war are complex decisions. The Ukraine-Russian crisis is carefully worded at present to not be an act of war for example. All requiring clear definitions, that maybe hard to document.

“I think that the takeaway (‘from the Mondelez Zurich Case’) is that war exclusions in all lines of business need to be updated and modernized to expressly address coverage around state sponsored cyber attacks or cyber operations,” said Vince Vitkowsky, partner at law firm Gfeller Laurie.
