Export controls are no doubt a strength for a country like the UK trading with the U.S. But one has to ask about cybersecurity and the role of U.S DFARS cyber regulation for the Defense Industry. Cybersecurity that is considered by the White House (ONCD) to advance national security, economic prosperity, and technological innovation. Interestingly ITAR can include CUI, and CUI is governed by DFARS cyber regulations – (https://lnkd.in/e3jSrvMS).
It was interesting to see the recent U.S Supreme Court ruling pertaining to the False Claims Act (FCA) and the bar set by the court for testing FCA compliance ‘Supreme Court held that the FCA⬢s scienter element refers to a defendant⬢s subjective knowledge and beliefs’. Compliance that could be relevant for DFARS in as much as the DFARS cyber requirements are well documented and likely signed as self attested, or submitted to DoD SPRS by a contractor and subcontractor.(https://lnkd.in/e_xDCWxc)
With heightened concern in Washington over cybersecurity, one wonders how cybersecurity compliance will effect its relationship with allies? Given the U.S, EU and Australia are implementing cybersecurity risk management regulation, followed by the Securities and Exchange Commission(SEC)?
