I am please to enclose the paper that I and Jamie Foster of Hill Dickinson LLP wrote on the EU NIS 2.0 directive. Discussing the opportunities and challenges the directive poses to organisations and leadership teams. Allot has been said about NIS 2, it will be transposed into EU Nation State laws in 21 months and affect a broad very range of Critical National Infrastructure(CNI) providers. It has been closely reference with other planned EU Cyber risk management regulations, including DORA, The resilience of Critical Entities Directive and Cyber resilience Act (Note the use of certified products).

The management teams of CNI providers should pay close attention to NIS 2. Enforcement penalties include temporarily suspending management decision makers, licenses to operate and fines. Fines that could be levied ‘Left of bang’, as the directive sets out requirements for the use of risk-based ‘ex ante’ and ‘ex post’ on and off-site supervision. NIS 2 also leaves the door open to both civil and criminal penalties, against entities and persons.

With both the U.S and Australian regulators working towards similar CNI cyber regulation. National and international organisations trading in and with these jurisdiction should take a closer look at compliance.

Any questions please reach out.
