New York and New York state take the lead again, following the release of its NYDFS cyber regulation. If it gets passed the SHIELD (Stop Hacks and Improve Electronic Data) legislation will put in place stringent data protection laws. Including the need for companies to put in place data security controls.
It will apply to any person or company, regardless of location. who holds data of a New York resident (state specific GDPR). Which could make this sweeping impacting more than companies who reside in the state.
Meaning any asset where personal data belonging to New York residents could fall under the act. It will be interesting to see how they oversight it. Given the propensity for litigation in the US, it will provide more regulation and force tighter controls into companies which maybe a good thing. I wonder which state will be next?
