One is not convinced the Jaguar Land Rover hack will jeopardize the UK economy; the Automotive industry is not what it once was. But clearly, the UK government is adopting a rather interesting approach to cybersecurity, especially when one considers the approach that its allies are taking. The UK’s approach to cybersecurity regulation is more likely to jeopardize the UK economy than the JLR hack ever will.
Our partners are building cyber regulatory walls that will prevent the UK industry from selling their products or services in the EU or the US on the grounds of security. Unless UK industry complies with cybersecurity risk management regulations.
EU NIS 2 and DORA impose strict cyber requirements on EU nation states and their CNI providers, Financial Institutions. The EUs Cyber Resilience Act (CRA) requires companies that sell or distribute digital products across the 27 member states to implement cybersecurity. Before anyone goes, that won’t impact me; these regulations follow the supply chains as they follow the risk. Meaning they cross back into the UK. So while the UK may think it’s got a moat around it, the moat doesn’t stop cyber and ICT risk transfer.
The US DOD DFARS cyber regulations have been in place for 8 years (2017). They have to follow the supply chain, from US Primes and down. Wherever the Controlled Unclassified Information flows, and that flows to UK Defence Contractors. One cannot see the US administration relying on the special relationship when it comes to national security. The UK DIB either complies with what the customer wants (you’ve probably already signed the contract, but didn’t read the small print), or you leave the market, or are forced to leave the market.
So while the UK may be taking a more hands-off approach to cybersecurity, our partners have not. If we want to trade with them, we have choices to make to follow their rules or not. One believes, for all the right reasons, that it makes sense to regulate cyber; everyone else is. Maybe we know better?
