Thank you for posting Judy Selby, an important update on the role subrogation plays in cyber insurance. As cyber insurers take on the process of recovering losses from third parties.
Irrespective of whether insurers are successful or not, the process of subrogation, as demonstrated in the Axis case, extends the timeline by which covered companies are held in the spotlight.
As cyber regulation starts to find its feet, covered organisations are required to demonstrate reasonable, adequate, and evidential oversight and assurance of their cyber security risk management, and that of theirs. One suspects that subrogation will become easier as evidence of compliance, or otherwise, will be tested.
