Thank you for posting Richard Staynings. The letter sent by Senator Cotton is a reminder of the challenges faced in the adoption of cybersecurity for all digitally enabled technology. globally

There is an obvious issue, though, as Senator Cottons Letter alludes. While the FDA regulates cybersecurity risk management of digital medical devices that enter the US marketplace. What regulator exists to retrospectively address the cybersecurity of devices pre-dating the FDA’s regulation?

There is also a further issue, and it’s the same issue that is faced by every cyber regulator globally, and that is one of regulatory adoption and enforcement. Digital dependency and cybersecurity are major concerns as the latest technology, driven by AI, opens doors and levels of security automation that make older, unregulated technology a prime target.

There is also the question of enforcement. We see this with the United States Department of War CMMC program. Where compliance with a 10-year-old DFARS requirement by the international DIB is relatively low. If regulators enforced regulations, then market dynamics would change, and cybersecurity would be adopted.
