Thank you for posting Ted Dziekanowski. Those pesky war exclusions have it again, demonstrating the serious side of these exclusion clauses. The WWII bomb, albeit 79 years old, had a defined purpose when it was dropped all those years ago. A purpose that was fulfilled when the MoD bomb squad detonated it in 2021. It exploded and caused damage.
As the insurance industry comes to terms with the Merck judgement earlier in 2023, one can expect policies to be significantly better worded to address exclusions from nation state threat actors and acts of war. Albeit when does a nation state or proxy cyber attack constitute an act of war. Or where is the line draw between nation state, proxy and cyber criminal, and whose going to be able to demonstrate where the line is drawn.
Why does one feel that the courts will be wading into the debate before to long?
