Thank you Ted Dziekanowski, the DoJ settlement is an example of the challenges ahead for cybersecurity. The DoJ civil cyber fraud initiative and the enclosed settlement is an example of the regulatory enforcement that is being tested in the US.
There are a number of cybersecurity regulatory and compliance programs in the U.S. at the moment. On the 26th April the Aerojet Aerojet Rocketdyne case goes back to court and will test the use of the False Claims Act and the implementation of cybersecurity as required under Federal Contracts. The SEC is proposing cybersecurity risk management, strategy, governance, board and incident disclosure. The SolarWinds case is also moving ahead and looking as though the CISO will testify in court. The US DoD DFARS and CMMC program is moving forward for US Defense contractors. Cyber incident reporting for CNI contractors and FISMA 2022 has been signed.
For me all this activity is starting to develop and test cybersecurity and risk management compliance. Setting cybersecurity regulatory, compliance and legal benchmarks in line with new and old cybersecurity regulations in the U.S. that will impact organisations trading with the U.S.
