The Harvard Law School outlines the state of enforcement actions by the SEC over the past year. 2022 saw some cyber activity by the SEC enforcing cyber incident disclosures. However following recent events focused on crypto and VC financing 2022 one suspects that the 2023 review maybe an interesting read.

2023 is very likely to see the release of the SEC cybersecurity risk management proposal, for the oversight and assurance of cybersecurity risk management. Increasing corporate disclosure obligations for cybersecurity risk management, strategy, governance and incidents. If the proposal makes it out the gates it will set out requirements for corporate boards to manage cybersecurity risk. Requirements that will place cyber legal and compliance risk for cyber into the board room.

The recent FTX, SVB and Silvergate only serve to increase regulatory oversight.
