The release by the US President of the enclosed Executive Order, ‘Prioritizing the Warfighter in Defense Contracting’, is an important read for the Global US Defence Industry Base (DIB). As the President targets cost, quality, and delivery of US Defence contracts, executive compensation, share buybacks, or investor profits at the expense of warfighter capability and readiness.
The move is significant as the US changes the gear of US defence production to place it on a war footing. The EO stipulates that the Secretary of Defence will identify underperforming defense contractors and, where remediation plans are deemed ineffective, utilise contract enforcement mechanisms in FAR and DFARS.
This raises uncomfortable questions about cybersecurity, DFARS, and CMMC. As the global DIB is already expected to comply, and fund appropriate cybersecurity compliance defined by DFARS 252.204-7012. It has been demonstrated that many US DIB contractors do not comply.
Will we see more False Claims Act cases, alongside the use of other FAR and DFARS mechanisms, and contractual penalties for performance by the DIB?
