The U.S. Securities and Exchange Commission has withdrawn the proposed broker dealer cybersecurity rule that required advisers and funds to adopt and implement cybersecurity risk management programs, policies, incident reporting and public disclosure requirements. The SEC has also withdrawn the Cybersecurity rule that required broker-dealers, clearing agencies, major security-based swap participants, the Municipal Securities Rulemaking Board, national securities associations, national securities exchanges, security-based swap data repositories, security-based swap dealers and transfer agents to address cybersecurity risks.
What next for the SEC final cyber rule? At a time of increased global tension, where cyber is being used to threaten national security, what levers will the SEC use to secure CNI?
