The US Department of Defence continues to focus on the security of its supply chain. It is extending requirements for companies to declare Foreign Ownership, Control or Influence (FOCI) to unclassified contracts and subcontracts greater than $5million.

The DoD published a proposed rule (DFARS Case 2021-D011) on the 6th May, extending the current requirement that prohibits the awarding of classified contracts to companies that are under Foreign Ownership, Control, or Influence without appropriate mitigation to non-commercial defence contracts of more than $5 million. The rule affects contracts and subcontractors, who will be required to submit information to the Defence Counter Intelligence and Security Agency (DCSA).

One wonders the impact of this ruling on the International DIB, which will be required to validate FOCI down the supply chain.
