This is by far the best synopsis I have read of the cyber insurance market and the challenges insurers face. The article reviews the book by Professor Josephine Wolff Cyber insurance Policy: Rethinking Risk in an Age of Ransomware, Computer Fraud, Data Breaches, and Cyberattacks†(MIT Press, 2022).
Professor Wolff provides an analysis of the origin and evolution of the cyber insurance market. Through an analysis of lawsuits, cyber insurance policies, government records, and media coverage, She describes the current state of cyber insurance and explores the development of the cyber insurance market by examining regulatory changes, legal battles in courtrooms, and shifts in public policy.
In my view Professor Wolf captures the unique nature of cyber insurance as a risk transfer tool, and the challenges both the insured and insurer face in managing the risk. I especially like the global perspective she applies to cyber, the lack of regulation and the complex issues cyber insurers now face in underwriting cyber policies.
Reading the review you can relate to the challenges we now face in managing cybersecurity risk. That are leading to increased cyber regulation and the transfer of risk management back to the insured.
