To quote a phrase, ‘The game is afoot’. CMMC requirements are now being added to Defense contracts by the DoD. A simple search for CMMC on Sam.gov highlights active contracts that require contractor clarification of CMMC status for contract award.

Currently, there is a mix of contracts that highlights the broad diversity of covered contracts, which includes, for example, construction and infrastructure contracts.

CMMC will be progressively added to contracts as the Department of War formalises DFARS 252.204-7012 assurance across the four phases of CMMC, over the next 3 years. The first phase is CMMC level 1 and CMMC level 2 self-assessment and affirmation in SPRS in 2026. With a provision that the DoW can add a requirement for a certificate of CMMC at level 2.

An open question: If a contract requires clarification of CMMC to tender. Does that mean the contractor is clarifying the flow down of the CMMC level when they tender?
