Call us now:
With the Mondelez Vs. Zurich case running through the courts (https://lnkd.in/ekihftc). Things may have got decidedly more difficult for cyber insurance policies. With the US President signing of executive order 13873.
It looks like the order opens the door wider in terms of implicating both sovereign powers and entities within sovereign states when it comes to cyber attacks and acts of war. The act appears to associated citizens and entities within a foreign adversary, to the foreign adversary. (https://lnkd.in/eYtyqye). Leading to an argument that they could be treated as the same. That a cyber attack launched by an individual or entity is no different from a nation state.
I’m no lawyer and some of the wording goes straight over my head and I’m sure it will require a little bit of precedent setting in court. But and its a big but; it may impact the interpretation of cyber insurance polices and the payout. The Mondelez vs. Zurich case will set some precedent.
