With the SEC cybersecurity risk management program pending and U.S DoD DFARS/ CMMC, one has to wonder the role of Whistblower program in cybersecuirty risk management compliance? The U.S DOD DFARS program requires covered entities to implement NIST SP 800-171 and attest compliance through self assessment and input compliance to the DoD. Compliance that is likely covered under the False Claims Act, an act that dates from 1863 and applies to organizations that receive funding from U.S Federal Agencies. Federal Agencies that have Whistleblower programs that returned over $2bn in FY 2022 to the federal purse (https://lnkd.in/eEkCkUMH).
With increased U.S cyber regulation, the DoJs cyber civil fraud initiative and low levels of cyber maturity, one has to ask what role the Federal whistleblower programs and FCA could play in cybersecurity risk management compliance for boards supplying Federal agencies? The FCA is a mature well tried program with a proven record of success and a lucrative 10% – 30 % of funds returned to whistleblowers.
