Are investors using the SEC Final Cyber rule? As investors bring a securities class action suit against the South Korean E-Commerce company Coupang. Following its November 2025 data breach. The class action is focused on the alleged failure of the company to carry out its fiduciary duties.

The complaint alleges Coupang had failed to uphold its fiduciary responsibilities by having inadequate cybersecurity protocols that led to a security breach, exposing the company to a materially heightened risk of regulatory and legal scrutiny. Investors who purchased Coupang shares between Aug. 6 and Dec. 25 are being encouraged to join the suit as Coupang’s market capitalization fell to $42.4 billion from $53.3 billion.
