A further example of the challenges CISOs face as a former Uber lawyer testifies in court against Ubers former head of security. The case evolves around Ubers 2016 data breach and allegations that the company tried to cover up the breach.
The UK Guardian newspaper pointed out last week that the court case is a landmark trial. With federal prosecutors alleging in court filings that in an attempt to cover up the security violation, the head of security had instructed his team to keep knowledge of the 2016 Breach tightly controlled†and to treat the incident as part of the bug bounty program. For me this is a further example that sits along side Twitter and SolarWinds, highlighting the regulatory and legal challenges for CISOs and casts a light on board room governance and oversight of cybersecurity.
Decisions that both board members and CISOs make for their organisations are increasingly likely to be adjudicated in court. With the increased expectations that cybersecurity risk management will be regulated, the role of the CISO will get much harder.
