AI is changing so many norms. In this case, the attorney-client privilege has been brought into question as a judge in the US ruled that documents created by a defendant and sent to his attorney do not fall under attorney client privilege. Inasmuch as AI is not confidential, the documents should not be treated as privileged.

This has implications for uses of AI in regulatory compliance. Should companies use AI when working through regulatory compliance? Will documents be considered privileged in the event of a regulatory issue and investigation, maybe creating discoverable materials?
