An informative article on cyber insurance. The announcement in January 2022 that Merck was entitled to a summary judgement following the Not Petya cyber attack of 2017. Set a precedent for cyber insurance claims and the use of the act of war exclusion clause in policies. (https://lnkd.in/ddBtw8cW)
Now there is a war between Ukraine and Russia that has involved many nations, what will be the impact on cyber insurance policies? Cyberspace is an agreed NATO domain of operation and with western hackers targeting Russian organisations there is a likely retaliation by Russian state sponsored hackers and their proxies. That will likely again test the war exclusion clause.
The Ukrainian Russian conflict is the first hybrid war and will test the extent to which organisations have implemented appropriate cyber practices. This time cyber insurers have been working to tighten their policy exclusions, but one predicts more cases will be tested in court.
