An interesting read on the changing landscape of cyber incident response. As organisation in the US are increasing reaching for their external legal councel before the incident response team to manage an incident. The regulatory and legal implications of a cyber breach are front and centre. With organisations starting to recognise that cyber impacts balance sheet, brand reputation and market value and may end up in court.

The complexity of hacks does not just relate to the hack, the complexity of regulatory compliance is also increasing significantly. Other aspects of a cyber attack are also changing, cyber insurance premiums are on the way up and cyber insurance coverage is on the way down. Creating problems for those companies that have been hacked, requiring a broader understanding of corporate and commercial law. As the impact of a cyber-attack can be balance sheet wide and may end up in legal complications and court.
