As always Johnathan Rudy a great writeup on the ongoing SolarWinds SEC case.
The case has and is being debated in the court of public opinion and irrespective of the SECs final cyber rule (2023), one finds it difficult to see how the case can do anything other than go to trial. To clarify the statements made by SolarWinds and the SEC and bring a conclusion to the charges raised.
It will certainly create caselaw and a benchmark for compliance to cybersecurity risk management under securities law. The SolarWinds CISO seems to be the main focus of the case.
