One to read if you can access, as the ex Uber CISO appeals to get his 2022 conviction tossed by three 9th circuit judges. A case that has potential implications on bringing civil and criminal penalties against CISOs for their management of cybersecurity. The appeal discusses aspects of the original trial including the role the CISO had with General Counsel and the bub bounty program.

There was a degree of skepticism by one of the judges in the case. The CISO was accused of illegally funneling the money through Uber’s bug bounty program, where researchers are paid to find and report security flaws. At what point does it stop being bug bounty and start being unauthorized hush money? De Alba asked.

Ex-Uber Exec’s Actions Smell Like Cover-Up, 9th Circ. Judge Said.

The case is the first time prosecutors held a tech executive criminally liable for their actions and the outcome of the case has consequences for organisations that are covered under government regulations in the U.S.
