The SEC looks to be under pressure from Senators calling for it to go further following last weeks proposal to regulate cybersecurity for investment funds. Senators are asking for publicly traded companies to disclose to investors if they have a cybersecurity expert on their board, as part of the Cybersecurity Disclosure Act.

If proposed and regulated it will impact all public companies trading on SEC covered markets, that includes those UK and EU organisations.

For defense contractors this may not be onerous, as the DoD DFARS and CMMC program set cybersecurity compliance requirements in order to deliver for DOD Contracts. Although the DoJ civil fraud program will add significant regulatory and legal risk, given the fine regime under the False Claims Act.
