The SEC – SolarWinds case was one of the first major, public, forays to oversight cybersecurity risk management of participants in U.S capital markets. While in this case there maybe an evens chance that the legal strategy is to push the case out to a more favorable climate (why wouldn’t you). However cyber remains a major issue for the new administration, that historically passed major cyber regulations and one that likely understands that it if is to MAGA, it has to protect national interests, that includes through cybersecurity.Governments have pulled all the levers available to enforce cybersecurity, there are few leavers left outside of regulatory oversight. Letting SolarWinds off the hook will likely send the wrong message. Also one only has to look this side of the pond, where cyber regulation is moving at pace into 2025. Regulation that will require some U.S companies to comply, or they will not be able to trade in the EU.How do we balance national security, international trade, the protection of corporate IP and competitive advantage?Johnathan Rudy @Thaddeus Dziekanowski Brian D.
