If ESG reporting requirements continue to follow their current trajectory and don’t get derailed, then in all likelihood they will get rolled to the boardroom enforce and not just impact corporate America, but all publicly trades company on US markets.

This is important for cyber, the SEC has mentioned that cybersecurity is being considered for inclusion under the ESG regime, as it creates a significant material impact to the balance sheet. Also the regulatory direction of travel is clear for US Cyber, with 2 important EOs in 2021, SCRM (Feb) and cyber (May). (Moody’s downgraded Equifax senior unsecured to Baa2 in 2020, raising cashflow concerns related to the remediation following its 2017 hack)

ESG one to watch for public firms. The SEC has more teeth to bare and a harder bite than other public regulators. They cut off access to capital markets, impose significant fines and push for custodial sentences. Litigation risk in the board room which increases through misrepresentation, unfair and deceptive business practices and, securities fraud.
