The Commodities Futures Trading Commission (CFTC) recently awarded $200Million to a Whistle-blower.

‘whose specific, credible, and timely original information significantly contributed to an already open investigation and led to a successful enforcement action, as well as to the success of two related actions, by a U.S. federal regulator and a foreign regulator’

What does this tell us about the use of whistleblower programs in the US. Especially their noticeable, publicised, and successful use by US regulators pursuant of Federal regulations? Add to this the recent DoJ announcement and their intentions to utilize the False Claims Act (FCA) to pursue cybersecurity related fraud by government contractors and grant recipients.

I expect the use of the regulatory ‘stick’ to be much greater than the ‘carrot’ going forward.
