Regulation sets the guard rails that we work within, irrespective of national, industry or regulations set by professional associations. The same is true for cybersecurity with a range of regulators starting to define the basic requirements for cybersecurity risk management.
The case between SolarWinds and the SEC is yet to conclude, and one must remember that the case was tried under regulation prior to the 2023 SEC cyber rule. One wonders the effect of the new regulation on firms that are now covered under the SEC cyber rule, such as United Health or CDK?
One suspects that the SEC and SolarWinds have some way to go before things are concluded.
