Cyber threats are only the start of the problems that lie ahead for the General Counsel, when one considers cyber threats. Cyber is a legal and compliance issue for boards and lawyers. As we have written many times with Rachel V. Rose, JD, MBA.

While cybercrime is a top three issue for lawyers; so is the rapidly developing legal landscape that is evolving around cybersecurity risk management. A landscape that includes dealing with cyber threats; class action suits for failing to deal with cybersecurity; cyber regulatory compliance and corporate governance. Cyber regulation in the U.S under the SEC, EU NIS 2 and DORA set out clear corporate obligations for cybersecuirty risk management. Obligations that will be tested in court.

In 2023 Rachel, myself and @Thaddeus Dziekanowski ran sessions with myLawCLE and the Federal Bar Association for U.S attorneys to understand that rapidly developing cyber legal landscape and the opportunities and threats that lawyers face. In mid-2024 we briefed the The Government of Dubai Legal Affairs Department and GCC lawyers.

Watch for our 2024/ 2025 program we are running for lawyers, written with Rachel and Ryan Buckner of Schellman. Increasing awareness of the rapidly evolving cyber legal and compliance landscape, and the effects on Board corporate governance, cybersecurity risk management, audit and law.
