A great article discussing the implications of this week ruling by the U.S Supreme Court, adjudicating on the SECs use of in house courts. Limiting the ability of the SEC and other Federal agencies to adjudicate cases through their own in-house tribunals that allowed the SEC to take the role of judge, jury and executioner.
“Make no mistake: Today’s decision is a power grab,†wrote Justice Sonia Sotomayor, joined by Justices Elena Kagan and Ketanji Brown Jackson. “It prescribes artificial constraints on what modern-day adaptable governance must look like.â€
One wonders the effect the ruling will have, if any, on cybersecurity regulatory oversight. It may actually be more prudent to allow defendants to be tried in a court of their peers. As demonstrated by the current SolarWinds which is being adjudicated, with the SEC seeking trial by jury. An indication maybe the SEC expected the outcome of the Supreme Court.
