The FTC has petitioned a Nevada court to require MGM to answer questions related to the 2023 cyber attack. To enable the FTC to conduct its investigations.
The enclosed petition details the legal to and froe between the FTC and MGM. One wonders how this will proceed. By providing information to the FTC MGM opens up the company to the possibility of civil action. On the other hand if the court agrees with MGM, then the FTC investigation is made more difficult. However MGM has a track record of data breaches, that may not go in its favor (https://lnkd.in/e_XrWNy6)
However we have as yet not heard from the SEC over the MGM hack. One noted that while the 2023 hack affected many customers, the hack was unlikely to have been material to the company. The hack was also prior to the effective date of the SEC Cyber rule.
The outcome of this petition will decide how quickly an investigation in the MGM hack proceeds and next steps by Federal agencies and MGM.
