There’s a slow awakening that EU NIS 2 and DORA are on their way and they will affect the boards of covered entities, that includes the potential for civil and criminal penalties and temporary board suspensions. In Ireland alone over 4,000 companies will be affected by NIS 2 regulations. Regulation that requires organisations to implement cybersecurity risk management, oversight, assurance and attest cybersecurity risks. Boards are required to demonstrate Governance over cybersecurity, and their knowledge skills and experience to manage cybersecurity risks. Being prepared to ex-post and ex-ante audits from their national cyber regulators.

In 2023 we wrote and delivered cybersecurity risk management education programs for U.S attorneys, accredited by Thompson Reuters and The Federal Bar Association that addressed cyber-legal regulatory compliance to EU NIS 2, DORA and the SEC final cyber rule.
