The Maritime industry is facing cyber regulation that includes EU NIS 2 (From October 2024) and the Securities and Exchange Commissions Final Cyber rule (From September 2023). Cyber regulation that requires maritime covered entities to demonstrate the management of cybersecurity risk, board governance, incident disclosure and where required disclose compliance to the regulator. Both regulations can impose civil and potentially criminal sanctions on the Boards of Directors and accountable executives of covered entities.
Earlier this year Peter Thornton of law firm Hill Dickinson and I published the enclosed paper on EU NIS 2 and the Maritime Industry. The scope of NIS 2 includes electricity generation, distribution and transmission; oil and gas production(storage, distribution and transmission). The manufacture of transport equipment, which includes the building of passenger and cargo vessels, tankers, tugs, warships, drilling platforms and floating structures. Since then SEC final rule is effective for both U.S Domestic and Foreign Private Issuers in the maritime industry. Increasing the regulatory scope of some firms in the EU and effecting the cybersecurity of the supply chains of covered organizations.
In our paper we introduce NIS 2 and the cyber regulatory outlook for the Maritime industry.
