A great session with Rachel V. Rose, JD, MBA as we discussed U.S and EU cyber regulations and fiduciary issues associated with regulatory compliance with U.S attorneys. We analyzed some of the recent cyber regulatory developments, legal challenges and the potential effects of the recent Supreme court ruling affecting the False Claims Act (FCA). We examined in depth U.S and EU cyber regulations, cyber risk management compliance and the effects of regulation, as it pushes cyber ‘left of bang’ into the board room of covered entities.
As many will know I am interested in the effects of the FCA on the U.S national and international DIB. It is well documented that cybersecurity requirements under DFARS 252.204 – 7012 have not been applied across the global DIB resulting in the compromise of defense IP (GAO words not mine). What questions, if any, does it raise for contractual compliance to known and agreed cyber standards, while accepting U.S Federal funding?
