Thank you Rachel V. Rose, JD, MBA, it’s an interesting post indeed. One wonders what this means then for the next round of court cases, if under Delaware law the directors cannot be held accountable for ‘simple negligence’. A judgement that maybe considered fair based upon the law at the time. But with the SEC hovering around, it may not be over for SolarWinds (https://lnkd.in/eahtzE6P).
Does this increase the pressure on regulators to act on cyber security? Allot has changed in the proceeding 3 years.
