A great article Rachel V. Rose, JD, MBA. They say the greatest gift for Christmas is love, empathy, compassion, charity and knowledge. Well in the case of current and proposed board regulation, knowledge, specifically cyber knowledge, maybe high up on the list of what goes in the stocking of board members. Cyber used to be a FUD debate (one suspects for many board members it still is), but Santa and his helpers have been busy in 2022, crafting lots of cyber regulatory presents. Cyber regulation that with existing regulations such as SoX, requires boards to be active on the oversight, assurance and attestation of cybersecurity risk management.
The ONCD has been busy wrapping its cybersecurity strategy, the SEC has been wrapping its cybersecurity risk management proposal, the elves over at NYDFS repainted their cyber regulation for covered entities. Santa’s helpers in the EU made EU NIS 2.0 and DORA and Santa’s Reindeer over in Australia have been hot to trot. All ready for a new reason in 2023.
For those children that have not been nice the DoJ and DoT have their own surprises under regulatory enforcement tree, and the cyberinsurance industry has been taking toys away from those who have been naughty in 2022.
So maybe a stocking filler of board cyber risk management awareness will be a useful gift for this festive season?
