The rise in visible cyber attacks in Australia has facilitated the government to make legislative proposals to regulated cybersecurity compliance. However the legislation of ransomware payment is a thorny issue, on one hand organisations need to get up and running quickly following a cyber attack and paying a ransom may help this. On the other in most cases the ‘keys’ are never returned, and prevention would have been the better option.

Reviewing U.S Department of Treasury (DoT) guidance on ransomware payments maybe useful. If a person, organisation or jurisdiction is on a OFAC list then approaching law enforcement before a ransomware payment is made is advised. To get access to expertise, save time and potentially reduce the impact of regulatory enforcement in the future.
