The DoJ is moving ahead with its program requiring CEOs and Compliance Officers to attest the effectiveness of their corporate compliance. Applying it earlier this year in the Glencore resolution.
With the amount of cybersecurity regulation making its way through Federal Government at present. The DoJs requirements for compliance attestation is going to make the role of CISOs more complex. Current U.S cyber regulatory proposals are more prescriptive in nature allowing for interpretation in compliance. By its nature allowing for more margin to assess and attest compliance.
The certifications serve as a tool for the Justice Department as it tries to hold individuals accountable for their role in corporate wrongdoing, said Alixandra Smith, the deputy chief of the criminal division at the Brooklyn U.S. attorneys office.
One expects that as the DoJ moves ahead they will make executives accountable and back this with enforcement actions.
