A comprehensive cybersecurity and telecommunications bill has been introduced to Canada Parliament this week, enacting the Critical Cyber Systems Protection Act to provide a framework for the protection of the critical cyber systems of services and systems that are vital to national security or public safety in Canada.
The Act aims to protect systems critical to the services provided by telecommunications, interprovincial or international pipeline and power line systems, Nuclear energy systems, Transportation systems within the legislative authority of Parliament, Banking systems and Clearing and settlement systems.
It will require operators of critical services to identify and manage cybersecurity risks, protect systems from being compromised, detect cyber attacks, minimize the impact of cyber attacks, take reasonable steps to manage supply chain and third party supplier risks and IMMEDIATELY report cyber incidents that affect its critical cyber systems, to Canada’s Communications Security Establishment.
The Act is underpinned by impressive powers of regulatory oversight, assurance and enforcement given to the appropriate industry regulators. The penalties for violations include director or officer liability and fines.
