I have made several comments on the SEC whistleblower programme over the past months. The SEC has moved further to strength the programme, one which it sees as an important tool in the governance and oversight of its covered entities. It highlights its effectiveness, by awarding around $523Mn to 97 individuals, ranging from $50Mn down to $5Mn. With 2020 seeing more claims processed than any prior year.
The enclosed outlines the basis behind awards, payments and improvements to be made to the programme. Including improving clarity of the enforcement process, improving the efficiency of payments and improving the protections afforded whistleblower them during the investigation process.
The SEC is a market regulator, there to protect investors. Regulations apply to all market regulated companies.
