This is definitely one to watch and getting a lot of column inches. Senator Roy Wyden is pushing his ‘Mind Your Own Business Act’ through congress. The act would bring in legislation to empower the Federal Trade Commission to fine tech companies that violate user privacy.

It would bring in extensive powers to make executives accountable for data privacy within their organisation. Corporate officers would be held personally accountable for their company’s behavior. If a business were found to be intentionally filing incorrect reports about privacy, executives would be subject to penalties up to 25% of compensation or $5 million, whichever is greater, and up to 20 years in prison. With lower significant personal penalties for minor infringements.

This act may not go anywhere, but alongside other proposals it sets a direction of travel for data privacy and cyber security in the US. An act will cross the line at some point in the near future.
