Are we starting to see more active use of the DoJs cyber enforcement program?In this case Raytheon Companies and Nightwing Group agree to pay $8.4m to resolve FCA allegations that relate to cybersecurity compliance under Federal Contract. The irony of the fine agreed by Raytheon, is that its scope covers Raytheon and Raytheon Cyber Solution Inc, that did not implement cybersecurity required under contract, specifically DFARS 252.204-7012 and FAR 52.204-21. Failing to secure federal contract information on 29 DoD contracts and subcontracts. The case was resolved under whistleblower provisions of the False Claims Act. Providing the Whistleblower, a senior engineer, former Director of Engineering with Raytheon, who will receive a $1,512,000 share of the settlement amount. The Whistleblower program applies globally to raise concerns against DIB contractors. So should be of special interest to the domestic and international DIB, its paid by the DIB contractor and likely cost neutral for the DoJ.One has said for the past several years that Defense cyber compliance is ripe for Whistleblower actions. Repeated assessments by the GAO and the well documented failures of security of US Defence IP have highlighted the likely failure of the DIB to comply with DFARS 252.204-7012. One suspects that the new presidential regime will be playing close attention to the elephant in the room, that is U.S DIB compliance to cybersecurity under DFARS 7012.“Strict compliance with contractual cybersecurity requirements is of dire importance to adequately safeguard sensitive information from sophisticated adversaries, assure the safety of our warfighters, and maintain our military’s competitive edge,” said Special Agent in Charge Greg Gross, NCIS Economic Crimes Field Office.One wonders how that US government will adopt stricter compliance oversight of DFARS to the international DIB?
