In these unprecedented times global data protection regulators including the ICO and European Data protection Board, (https://lnkd.in/emsuBYq), have been publishing guidance on the use and management of personal data. In both the ICO and EDPB believe there is enough flexibility in the regulations to support the processing of personal data whilst remembering.
1. Collect only relevant data, it’s reasonable for organisation to ask employees if they are suffering from the virus or if they have travelled to infected countries. Whilst being careful about collecting other health data.
2. Data protection regulation won’t stop companies sharing personal data with the authorities for public health reasons.
3. Required consent for sharing location data depends upon local law. Usually requiring consent and anonymised. But this can be changed by local laws as long as they are proportional, necessary and appropriate.
4. Consider the lawful grounds of processing and accountability, the principle of accountability applies. So evaluate the grounds for collecting personal data carefully and keep notes of the decisions made.
There are other observations. But the general theme is that data protection regulation provides the necessary latitude as long as we are sensible.
