Well worth a read. When what you don’t know or cannot prove may kill you, or at the very least hurt? There are plenty of data protection and cyber regulations out there, granted allot are US based. But they do tend to set the direction of travel for other regulations or are influenced in the case of GDPR. As the recent Uber case illustrates cyber is an increasingly litigious place and the pressures on companies and individuals will only increase.
Regulations and regulators have different breach reporting requirements. If you are unfortunate to be covered by HIPPA, CCPA, NYDFS and GDPR your life will be challenging, to say the least. So when you suffer a Ransomware, have you had a data breach and should you report it? We all know that it can be difficult to prove that a ransomware results in a data breach or theft. But there are organisations who have been blackmailed by the hackers, who threaten to report a data breach to a regulator on your behalf.
It’s a mine field for security, compliance and legal professionals who have to work with and advise the board.
